How to obtain confirmation of divorce from the Czech Republic?
In short, confirmation of divorce from the Czech Republic may take the form of either the actual court decision issued by the court of the Czech Republic that dissolved the marriage, or an annotation of the divorce on the Czech marriage certificate, in cases where the marriage was originally concluded in the Czech Republic.
Detailed explanation below:
Czech registry offices ("matrika" in Czech) do not issue any simple certificates of divorce (this type of document is not provided for in the country). Under the local system, a divorce in the Czech Republic can be confirmed by three alternative methods and documents:
- A court divorce ruling from the Czech Republic ("rozsudek o rozvodu manželství"). This means the actual decision issued by a state court that handled the divorce proceedings. In this case, the divorce process itself must take place directly in the Czech Republic by a local court, which then issues its ruling. This document can be obtained in physical form, complete with the court’s authentication and seal.
- A Czech marriage certificate. Interestingly, confirmation of divorce from the Czech Republic may also take the form of the marriage certificate itself, if the marriage was directly concluded in the Czech Republic. This is because, in the event of divorce, information confirming that the marriage has been dissolved is entered directly onto the marriage certificate as an additional annotation (the "Poznámka" field located at the bottom of the Czech marriage certificate). This annotation contains comprehensive details about the divorce, including when the ruling was issued, when it took legal effect, and which court issued the decision. Once this annotation has been added, you can obtain the new marriage certificate bearing this annotation, and from the perspective of Czech civil registry authorities, this document itself is considered confirmation (certificate) of divorce. It should be clarified that the addition of such an annotation does not always occur automatically, even where the marriage was both concluded and later dissolved in the Czech Republic (courts do not always automatically forward information to registry offices; based on our experience dealing with various Czech registry offices, this occurs in roughly half of cases). If the divorce took place outside the Czech Republic, the Czech authorities naturally have no record of it, and this annotation must be requested as a separate step. The good news is that Czech registry offices do accept court decisions from other countries for the purpose of adding this annotation. There are certain document requirements and a specific procedure, but this is entirely possible. - An extract from the Czech population register. The Czech Republic maintains a population register ("Registr obyvatel České republiky"), which includes all citizens of the country as well as foreigners officially residing here. An extract from this register contains all of a person’s data, including their marital status (whether they are married or not, or whether they were married but the marriage has since been dissolved). The extract does not specify the dates on which the marriage was entered into or dissolved, and therefore, frankly speaking, this remains an indirect way to confirm a divorce; nevertheless, it is one possible option. Thus, in order to obtain any form of divorce certificate in the Czech Republic, either the divorce process must be conducted directly by the state authorities (courts) of the country, or the marriage must be concluded in the Czech Republic and an annotation of the divorce must be added into the marriage certificate.
