How to Confirm Your Marital Status in the Czech Republic.

How to Obtain Proof of Marital Status in the Czech Republic

Unfortunately, there is no unified register in the Czech Republic from which you can obtain a certificate confirming a person's marital status (whether the person is married, unmarried, or divorced). No such register exists in the country.

If the marriage was registered or dissolved in the Czech Republic, the relevant documents can be obtained from the Czech Civil Registry Office in the district where the marriage was registered or from the court in the district where the divorce was granted, if it took place in the Czech Republic.

In this case, an alternative approach must be used. The Czech Republic has a Population Register ("Registr obyvatel České republiky"). This database contains records of all residents of the country and their basic data. The register includes all Czech citizens, foreign nationals currently living in the country, and individuals who previously lived in the country under long-term visas or temporary or permanent residence permits.

You can request an official extract of data from the Population Register for a specific person. While this document contains standard personal data (full name, date of birth, address, and more), its most important feature for this purpose is the person's marital status ("Rodinný stav" in Czech - a literal translation would be "family status," but in this context it corresponds to a person's marital status).

This field can contain the following statuses:

  • "Svobodný/svobodná" (single). This indicates that the person has never been married and is not currently married. This document can serve as confirmation that no marriage has been registered in the Czech Republic and that the person has never been married anywhere.
  • "Ženatý/vdaná" (married). This indicates that the person is currently married, although it does not provide any further details about the marriage.
  • "Rozvedený/rozvedená" (divorced). This indicates that the person is divorced but does not specify when or how the divorce took place. It can also serve as confirmation that the person is not currently married.
  • "Vdovec/vdova" (widower/widow). This status is used when the person's spouse is deceased.

Thus, an extract of data from the Czech Population Register can serve as official proof of a person's marital status.

The document can be obtained at any Czech POINT contact point. However, if the document will be used outside the Czech Republic, it must be requested from a notary public. Notaries have access to the Czech POINT system and can issue an extract with their own official notarial certification, allowing the document to be used internationally.

Furthermore, such a notarized document can then be authenticated with an apostille or, if required by the destination country, undergo consular legalization.

How to Obtain Proof of Marital Status in the Czech Republic

How Do I Obtain Proof That I Am Not Married in the Czech Republic?

As mentioned above, there is no single office in the Czech Republic where you can obtain this certificate. Czech civil registry offices are not part of a unified national network and are organized territorially, with individual offices for each city or district.

The solution is to obtain an extract of data from the Czech Population Register (the above-mentioned "Registr obyvatel"). This document contains the person's marital status. If the person is not married, the status will be listed as "Svobodný/svobodná" (single) or "Rozvedený/rozvedená" (divorced).

Logically, both statuses confirm that the person is not currently in a marriage registered in the Czech Republic or elsewhere. Currently, this is the only available method of obtaining such confirmation.

The extract can be obtained from any Czech POINT contact point. For use abroad, it must be issued directly by a notary. The notarized document can then be authenticated with an apostille or legalized through other required channels.

How Can I Obtain Proof of Marriage in the Czech Republic?

In the Czech Republic, it is only possible to obtain confirmation of a marriage (more precisely, a marriage certificate) that was officially registered in the country. To do this, you must contact the local Civil Registry Office in the district where the marriage was registered.

If the marriage was registered in another country, the corresponding document must be obtained from the authorities of that country.

Can I Obtain Proof of Divorce in the Czech Republic?

Yes, if the divorce was finalized by the authorities in the Czech Republic. The official result of such proceedings is a court-issued divorce decree ("rozsudek o rozvodu manželství"). This document is the primary proof of divorce.

Furthermore, if the marriage was also registered in the Czech Republic, the court will typically notify the relevant Civil Registry Office of the divorce automatically. The Civil Registry Office will add a corresponding note about the divorce to the marriage certificate. Consequently, obtaining a duplicate marriage certificate will also serve as confirmation of the divorce.

If the divorce proceedings took place in another country, you must request confirmation of the divorce from that country's authorities. However, if the marriage was registered in the Czech Republic but the divorce was granted abroad, the Czech Civil Registry Office can add a note about the divorce, after which you can obtain a duplicate divorce certificate that will serve as valid confirmation. We provide assistance with this procedure - please contact us if needed.

The same extract of data from the Czech Population Register can serve as indirect confirmation of a divorce. However, it will show only the general status ("rozvedený/rozvedená"), although this will likely also help resolve your issue.
